UAS Laws – General rules for flying drones in Argentina

Are drones allowed in Argentina?

According to ANAC, drones are allowed in Argentina for recreational and commercial use, subject to ANAC regulations. Read on for details.

Here are the most important rules to know for flying a drone in Argentina:

• All drones must be registered before the National Aircraft Registry of ANAC.
• The minimum age to operate a drone is 18 years old. Persons 16 and 17 years old may pilot a drone if accompanied and supervised by a responsible adult at the time of the operation.
• Drones are prohibited within 5 kilometers (3 miles) of ​​airports, aerodromes, and heliports.
• Drones are prohibited in densely populated areas or over crowds of people.
• Do not fly your drone higher than 122 meters
• You must fly during daylight hours and only fly in good weather conditions
• Do not fly your drone in sensitive areas, including government or military facilities. The use of drones or camera drones in these areas is prohibited
• You must maintain a visual line of sight with your drone at all times
• Do not operate your drone within 30 meters of any building

Drone categories

Drones are divided into several categories, the most relevant are the classifications by purpose and weight.

Purpose:

• Recreation: Use for recreation, hobby, etc., without any profit intentions
• Commercial: Use for profit

Weight:

• Class A: up to 500 grams
• Class B: more than 500 grams to 5 kilograms
• Class C: more than 5 kg to 25 kg
• Class D: more than 25 kg to 150 kg
• Class E: more than 150 kilograms

Drones must be registered, with the exception of Class A, for recreational use.

Application for Registration of the UAV / SVANT in the National Aircraft Registry

The procedure is carried out by TAD through Application for Registration of an Unmanned aerial vehicle.

Requirements for registration:

1. Proof of payment of the tariff (VEP/BP) generated in E-PAYMENTS.
   Pay the fee by selecting the small, medium, or large category according to the weight of the SVANT to be registered.
2. Declaration of Ownership of Unmanned Aerial Vehicle made through the Digital Aeronautical Locker (CAD), with a certified signature from the owner(s) or signatory/declarant. If you are not registered in the CAD, register here requesting a UAV profile.

Download and print the Unmanned Aerial Vehicle Property Statement.

The signing of this Affidavit must be certified by Notary Public or judicial authority. On each sheet, the declarant must be initialized and/or signed. In case the notary has his seat in a jurisdiction other than the Autonomous City of Buenos Aires (C.A.B.A.), his intervention must be legalized through the competent Professional Association.

If the UAV is registered in favor of a legal person, the president, managing partner, proxy, or legal representative must sign, and the notary / judicial authority certifying the signature MUST relate to the character, representation, and powers of the signatory. For natural persons, the declared address of the owner must coincide with the one on his ID card, and for people of an ideal existence, it must coincide with his registered registered registered office.

If the UAV is registered in favor of a state agency, the signature must be accompanied by an explanatory seal of the official in charge next to the oval seal of the institution (or digital signature, if applicable) and a simple copy of the administrative act of designation.

3. Acquisition title (commercial invoice, purchase receipt, deed of donation, contract of sale, etc.).
4. Photograph of sheet metal serial number of UAV.
5. Proof of current CUIT/CUIL.
6. Photocopy of the front and back D.N.I. of the owner(s). (Natural persons).
7. • Photocopy of the Statute or Social Contract and its amendments, with proof of registration in the Public Registry of Commerce or competent authority from which the registered registered registered registered office arises. (Legal persons)
   • Affidavit of the domicile of the state agency with signature and explanatory seal of the official in charge accompanied by the oval seal of the institution. (In the case of national bodies, submit a document generated through the GDE site)
   8. Additional documentation is contained in the Declaration of Ownership of Unmanned Aerial Vehicle. (Consistration of registration with the FIU, import documentation, etc.).

Once the submitted procedure has been analyzed, the resolution of the same (approval or correction) will be notified through the Remote Procedures (TAD) platform. If you are approved, you must download and print the registration certificate of your UAV from the Digital Aeronautical Box.

Notes for recreational drone pilots flying for fun in Argentina

You will not need a permit or a license to fly a drone in Argentina as long as you fly a drone weighing less than 10 kg and do not fly in a restricted/forbidden zone. However, you will need to register your drone prior to flying it in Argentina. 

To be eligible, you will also need to be at least 16 years old to operate a drone for recreational use in Argentina (if you are between 16 & 18 years old, you will need the supervision of an adult).

• Mark your drone with an identification plate.
• Fly at a maximum altitude of 122 m (43 m within controlled airspace).
• Fly during the daytime only.
• Fly a drone weighing less than 10 kg (you will need to register it if heavier).
• Fly 5 km away from airports, heliports (500 m) & give priority to all other categories of aircraft if you see an aircraft during your flight, land immediately.
• Fly away from vehicles and large crowds & respect individuals’ privacy. 
• Fly 30 m horizontally away & 10 m vertically away from people 
• Do not carry anything or drop any object with your drone. 
• It is advised to subscribe to insurance covering all risks. 
• Fly only one drone at a time & do not carry anything when flying your drone.
• Ask before flying to any governmental, religious, or military sites.
• Do not fly under the influence of any drugs or alcohol.

Notes for operating Commercial Drone Services in Argentina

Commercial drone operations require:

• Contract liability insurance for possible damages to third parties during the operation.
• A theoretical-practical evaluation approves authorization from the ANAC as a “member of the remote crew.”
• A psychophysiological aptitude certificate.
• An operations manual and an adequate risk management system.

During the flight, your drone must have a sticker with your name and address on it.
